By accessing or making a purchase from TractorGears.com (operated by Prime Powertrain), you agree to these Terms of Service.

1. Aftermarket Parts & OEM Trademarks All parts sold by Prime Powertrain are aftermarket replacement parts. They are not manufactured by, sponsored by, or officially endorsed by any Original Equipment Manufacturer (OEM), including but not limited to John Deere, JCB, ZF, Carraro, Dana Spicer, New Holland, Case IH, and Caterpillar. All OEM part numbers, brand names, and images are used strictly for identification and cross-reference purposes only.

2. Fitment & Application Responsibility Prime Powertrain utilizes extensive cross-reference databases to ensure compatibility. However, equipment manufacturers frequently make mid-year production changes. The purchaser assumes full responsibility for verifying that the part number is correct for their specific equipment model, serial number, and production date prior to installation. Prime Powertrain shall not be held liable for orders placed based on incorrect customer vehicle identification.

3. Pricing & Availability Prices are subject to change without notice. We reserve the right to correct pricing errors, refuse service, limit quantities, or cancel orders at our sole discretion.

4. Warranty All parts carry a 6-month limited warranty against manufacturing defects from the date of delivery. This warranty covers the replacement or repair of the defective part only. Prime Powertrain is not responsible for labor costs, towing, downtime, consequential damages, or any indirect losses. Warranty claims are governed exclusively by our Return & Refund Policy.

5. Returns & Refunds All returns, refunds, and restocking policies are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.

6. Limitation of Liability To the maximum extent permitted by applicable law, Prime Powertrain shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our products, including but not limited to labor costs, equipment downtime, loss of profits, or damage to other equipment components. Our total cumulative liability arising from any product sale shall not exceed the actual purchase price of the specific part in question.

7. Indemnification The customer agrees to indemnify, defend, and hold harmless Prime Powertrain, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to the customer's improper installation, modification, misuse, or misapplication of any product sold by Prime Powertrain.

8. Intellectual Property All content on this website, including but not limited to logos, text, graphics, and software, is the property of Prime Powertrain and is protected by copyright laws. Reproduction or distribution without written permission is strictly prohibited.

9. Governing Law & Jurisdiction These terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved exclusively in the courts located in the Province of Ontario, Canada. The customer hereby irrevocably consents to the jurisdiction of such courts and waives any objection to the inconvenience of such forum.

10. Changes to Terms We reserve the right to update these Terms of Service at any time without prior notice. Continued use of our website or services constitutes acceptance of the updated terms.
